【Lawful basis for data processing】

 The lawful basis for collection, use, disclosure, and transfer of your personal data are (A) our contractual relationship with you as our client; (B) our legitimate interest; (C) our legal obligations; and (D) your consent to the collection, use, and transfer of your personal data for the following purposes (if given): 

 

Ÿ   Processing your health conditions in providing career management and guidance service, if requested by prospective employers;

Ÿ   To carry out market research by using questionnaires;

Ÿ   Sharing the results of data analytics that contain my personal data with third party;

Ÿ   To distribute behavioral targeted advertising by cookies or other technologies or method

Ÿ   Share with relevant third parties as part of a proposed sale, merger, acquisition, joint venture, or transfer of assets.

Ÿ   To transfer all personal data 1) as outlined above; and 2) as designated under the Global Privacy Policy (RGF Services) to be under any basis other than contractual performance basis to group companies and data maintenance and other service providers anywhere in the world, for proper data storage and any purpose outlined above and in the Global Privacy Policy (RGF Services).

 

【How long will your Personal Data be held?】

 

We will retain your personal data for as long as it is necessary or relevant for our business purpose but not exceeding more than three years after the date of our last service provided to you. We may, however, store your information longer than that if required by law.

 

【Your other rights】

 

·        Request access to your personal data. You are also entitled to request us to disclose the acquisition of your data processed by us that is done without your consent

·        Request rectification of the personal data that we hold about you (e.g. where it is incomplete or inaccurate).

Relating to this, please note that it is our duty to keep your personal data up to date. Therefore, if there is any change to your personal data, please inform us accordingly. Otherwise, we will consider that the personal data you provided to us the latest is the most up to dated data about you.

·        Request erasure of your personal data, where there is no legitimate reason for us continuing to process it, subject to the relevant exceptions under the laws.

·        Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) for the processing in question. In such instances, we will be permitted to continue such processing if, balanced against your interests, there are compelling legitimate grounds for continuing to do so and/or for the establishment, exercise or defence of legal claims.

·        Request the restriction (suspension) of processing of your personal data (e.g. if you want us to establish its accuracy or the reason for processing it); and

·        Request the transfer of your personal data in a structured, commonly used and machine-readable format (where this is technically feasible) to you or to another party.

·        Withdraw your consent to the processing of your personal data. However, note a subsequent withdrawal of your consent will not have any effect on any data processing activities relating to your personal data we carried out prior to your withdrawal.

• Lodge a formal complaint with the relevant authority in the event that your complaint and/or dispute with RGF is not properly and timely resolved.

【ฐานทางกฎหมายสำหรับการประมวลผลข้อมูล】

ฐานการประมวลผลตามกฎหมายสำหรับการเก็บรวบรวม ใช้ เปิดเผย และโอนข้อมูลส่วนบุคคลของท่าน ได้แก่ (ก) ความสัมพันธ์ทางสัญญาของบริษัทกับท่านในฐานะลูกค้าของบริษัท (ข) ผลประโยชน์อันชอบด้วยกฎหมายของบริษัท (ค) หน้าที่ตามกฎหมายของบริษัท และ (ง) ความยินยอมของท่านต่อการเก็บรวบรวม ใช้ และโอนข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ดังต่อไปนี้ (ถ้ามี):

•     ประมวลผลข้อมูลเกี่ยวกับสุขภาพของท่านในการให้บริการจัดการหรือแนวทางอาชีพ ตามที่ผู้ที่จะเป็นนายจ้างร้องขอ

•     ดำเนินการวิจัยตลาดโดยใช้แบบสอบถาม

•     การส่งต่อผลการวิเคราะห์ข้อมูลที่มีข้อมูลส่วนบุคคลของท่านให้แก่บุคคลภายนอก

•     โฆษณาแบบเจาะจงเป้าหมายโดยแบ่งตามพฤติกรรมโดยใช้คุกกี้หรือเทคโนโลยีหรือวิธีอื่นๆ

•     แบ่งปันข้อมูลแก่บุคคลภายนอกที่เกี่ยวข้อง เพื่อเป็นส่วนหนึ่งของการขาย การควบรวม การได้มา การร่วมทุน หรือการโอนทรัพย์สิน

•     โอนข้อมูลส่วนบุคคลทั้งหมด 1) ตามที่กล่าวข้างต้น และ 2) ตามที่ระบุไว้ภายใต้นโยบายความเป็นส่วนตัวทั่วโลก (บริการอาร์จีเอฟ) ให้เป็นไปตามฐานใดๆ นอกเหนือจากฐานการปฏิบัติตามสัญญา โดยโอนให้แก่กลุ่มบริษัทและผู้ให้บริการบำรุงรักษาข้อมูลและผู้ให้บริการอื่นๆ ไม่ว่าประเทศใดทั่วโลก เพื่อวัตถุประสงค์ในการเก็บข้อมูลอย่างเหมาะสม และวัตถุประสงค์ใดๆ ที่ระบุไว้ข้างต้นและในนโยบายความเป็นส่วนตัวทั่วโลก (บริการอาร์จีเอฟ)

【บริษัทจะคงข้อมูลของท่านไว้นานเพียงใด】

บริษัทจะคงข้อมูลส่วนบุคคลของท่านไว้นานเท่าที่จำเป็นหรือเกี่ยวข้องสำหรับวัตถุประสงค์ทางธุรกิจของบริษัท แต่ไม่เกิน [•] หลังจากบริษัทได้ให้บริการครั้งสุดท้ายแก่ท่าน  อย่างไรก็ตาม บริษัทจะคงข้อมูลของท่านไว้นานกว่านี้ก็ได้หากกฎหมายกำหนด

【สิทธิอื่นๆ ของท่าน】

•     สิทธิในการขอเข้าถึง ข้อมูลส่วนบุคคลของท่าน นอกจากนี้ท่านยังมีสิทธิขอให้บริษัทเปิดเผยการได้มาซึ่งข้อมูลส่วนบุคคลของท่านที่บริษัทประมวลผลโดยไม่ได้รับความยินยอมจากท่าน

•     สิทธิขอให้แก้ไข ข้อมูลส่วนบุคคลที่บริษัทมีอยู่เกี่ยวกับท่าน (เช่น กรณีข้อมูลไม่ครบถ้วนหรือไม่ถูกต้อง)

โปรดทราบว่า บริษัทมีหน้าที่ในการรักษาข้อมูลของท่านให้เป็นปัจจุบัน ดังนั้น หากมีการเปลี่ยนแปลงข้อมูลส่วนบุคคลของท่าน โปรดแจ้งให้บริษัททราบ มิฉะนั้น บริษัทจะถือว่าข้อมูลส่วนบุคคลที่ท่านให้แก่บริษัทล่าสุดเป็นข้อมูลที่เป็นปัจจุบันที่สุดเกี่ยวกับท่าน

•     สิทธิขอให้ลบ ข้อมูลส่วนบุคคลของท่าน หากบริษัทไม่มีเหตุอันชอบด้วยกฎหมายที่บริษัทจะประมวลผลข้อมูลอีกต่อไป ทั้งนี้ ภายใต้บังคับและข้อยกเว้นที่เกี่ยวข้องตามกฎหมาย

•     สิทธิคัดค้านการประมวลผล ข้อมูลส่วนบุคคลของท่าน ในกรณีที่บริษัทประมวลผลโดยอ้างผลประโยชน์อันชอบด้วยกฎหมายของบริษัท (หรือของบุคคลภายนอก) แต่ทั้งนี้ ในกรณีดังกล่าว โปรดทราบว่าบริษัทอาจมีสิทธิในประมวลผลข้อมูลนั้นต่อไป หากเมื่อพิจารณาแล้ว ผลประโยชน์ของท่านได้สัดส่วนกับกิจกรรมการประมวลผลที่บริษัทจำเป็นที่จะต้องทำ หรือการประมวลผลนั้นเป็นการจำเป็นเพื่อการก่อตั้ง ใช้ หรือต่อสู้สิทธิเรียกร้องทางกฎหมายของบริษัท

•     สิทธิขอให้จำกัด (ระงับ) การประมวลผลข้อมูลส่วนบุคคลของท่าน (เช่น หากท่านต้องการให้บริษัทกำหนดความถูกต้องหรือเหตุผลในการประมวลผลข้อมูล) และ

•     สิทธิขอให้โอน ข้อมูลส่วนบุคคลของท่าน ในรูปแบบและโครงสร้างที่สามารถอ่านหรือใช้งานโดยทั่วไปได้ด้วยเครื่องกลทางเทคโนโลยี (ในกรณีที่เป็นไปได้ทางเทคนิค) ให้แก่ท่านหรือบุคคลอื่น

•     สิทธิในการถอนความยินยอม ต่อการประมวลผลข้อมูลส่วนบุคคลของท่าน อย่างไรก็ตาม โปรดทราบว่า การถอนความยินยอมของท่านจะไม่มีผลต่อกิจกรรมการประมวลผลข้อมูลใดๆ เกี่ยวกับข้อมูลส่วนบุคคลของท่านที่บริษัทได้ดำเนินการไปก่อนการถอนความยินยอมของท่าน

•     สิทธิในการยื่นเรื่องร้องเรียนเป็นทางการต่อหน่วยงานที่เกี่ยวข้อง ในกรณีที่เรื่องร้องเรียนและ/หรือข้อพิพาทของท่านกับบริษัทไม่ได้รับการแก้ไขอย่างถูกต้องและทันเวลา
